AOL OFFICIAL CONTEST RULES & GUIDELINES

 

1. Sponsor:

The “Contest” is sponsored by Appalachian Orthodontics of Lynchburg, located at 3700 Old Forest Rd, Lynchburg, VA 24501.

2. Entry:

No purchase necessary to enter or win.

To enter follow the instructions online at www.lynchburgorthodontics.com for the specific Contest. Each Contest will provide specific instructions, conditions, and rules which apply to the specific Contest. Rules specified on the Contest web-page will supersede these Official Contest Rules where applicable. Where there is a conflict between rules on specific web-page contest and these rule then the web-page contest rules will prevail. Rules not specified on the specific web-page contest will be governed by the following rules.

Contest webpage will specify the entry requirements. Alternative means of entry may be provided.

All entries must complete all required information for the specific contest. Missing or incomplete information may be a reason for disqualification.

By entering, Entrant warrants that his or her entry (1) is original and does not infringe the intellectual property rights of any third party, and (2) has not been published in any national magazine or website. By submission of an Entry, including but not limited to photograph(s), video(s), music, writings or any other materials, contestant hereby grants Appalachian Orthodontics of Lynchburg, and their agents (to the extent the contestant owns said rights) the right to print, copy, publish, use, edit, exhibit, distribute, perform, merchandise, license, sub-license, adapt and/or modify any Entry in any way (and to publish the contestant’s name), in any and all media whether now known or hereafter developed, without limitation and without compensation to the contestant.

Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Contest Rules, specific rules listed on the contest web-page and the decisions of Appalachian Orthodontics of Lynchburg, which are final and binding. Winning a prize is contingent upon being compliant with these Official Contest Rules, contest web-page rules and fulfilling all other requirements set forth herein.

3. Eligibility:

Employees of Appalachian Orthodontics of Lynchburg (along with its contractors, affiliates, and subsidiaries) and their families are not eligible. Void where prohibited by law. The contest is subject to federal, state, and local laws and regulations.

Past contest winners may not participate.

In addition, the following Eligibility applies to specific contest types:

3.1 Patient Contests:

For those contests that are Patient Contests, you must be a current patient of Appalachian Orthodontics of Lynchburg, legal U.S. resident, over the age of 18 or have parental/legal guardian consent, to be eligible to enter the contest.

Your Appalachian Orthodontics of Lynchburg account must be current.

3.2 Referral Office Contests:

For those contests that are Referral Office Contests, you must be recognized by Appalachian Orthodontics of Lynchburg as an eligible Referring Office. Contest web-page will specify whether the contest is open to individuals of the Referral Office or the entire Referral Office.

4. Contest Submission:

The Contest Submission Period will be specified on the contest web-page. Submissions may be accepted for the duration of the Contest Submission Period using the following methods (not all methods will be available for every contest – see specific contest web-page for details and exceptions).

Online: This method of entry will be available by visiting the contest page of our website (www.lynchburgorthodontics.com) and following the directions provided to complete the entry information, and submit.

Email: If permitted by the specific contest; this method of entry must follow the directions for Online entries at www.lynchburgorthodontics.com. The following email address is to be used for entries: contests@lynchburgorthodontics.com. Entries sent to any other Appalachian Orthodontics of Lynchburg email address will not be considered for entered.

On-site: If permitted by the specific contest; this method of entry is by appointment only at 3700 Old Forest Rd, Lynchburg, VA 24501. If you choose this method please call during normal business hours to make a contest submission appointment.

For contests that allow entries to receive votes, then entries submitted by email or on-site may not be available immediately for voting. Appalachian Orthodontics of Lynchburg will enter email and on-site entries into the contest system at their convenience and availability without restriction.

Unless otherwise specified entries are limited to one (1) entry per current patient for the duration of the Contest Submission Period, regardless of method of entry. Entries received from any person in excess of the stated limitation will be void. All entries become the property of Appalachian Orthodontics of Lynchburg and will not be acknowledged or returned.

5. Voting:

If voting is associated with the contest, the Contest Voting Period will be specified on the contest web-page. Only online votes at www.lynchburgorthdontics.com will be accepted for the duration of the Contest Voting Period. Voting requires at a minimum a valid email address (other requirements may be specified on the contest web-page). Those voting may only vote once per day, based on either a valid email address, IP address or other criteria, for a single entry (unless otherwise specified). Appalachian Orthodontics of Lynchburg reserves the right to review votes and determine the validity of each vote. All vote decisions by Appalachian Orthodontics of Lynchburg are final and are made without restriction.

6. Winner Selection:

Winners will be selected based upon the criteria specified on the contest web-page.

Appalachian Orthodontics of Lynchburg reserves the right to include or exclude any submission and/or votes at their sole discretion. All decisions of the Appalachian Orthodontics of Lynchburg are final and may not be appealed.

In the case of a tie, for those contest winners that are determined by votes, a random drawing from among the tied entries will be conducted by Appalachian Orthodontics of Lynchburg to determine the winner.

Appalachian Orthodontics of Lynchburg will attempt to notify the potential prize winners via telephone or email as specified on the contest web-page. If the potential winner cannot be contacted within five (5) business days after the date of first attempted contact, Appalachian Orthodontics of Lynchburg may select an alternate potential winner in his/her place at random from the remaining non-winning, eligible entries.

7. Winner Notification:

Potential winners will be notified by email or phone. If prizes are awarded as part of the contest and unless otherwise specified on the contest web-page each potential prize winner will be required to receive the prize in person and by appointment at Appalachian Orthodontics of Lynchburg office (3700 Old Forest Rd, Lynchburg, VA 24501) during normal business hours. Failure to arrange to claim the prize within five (5) business days after notification the potential winner will forfeit the prize.

If the potential winner is considered a minor by law, Appalachian Orthodontics of Lynchburg reserves the right to award the prize in the name of potential winner’s parent or legal guardian.

8. Prizes:

Will, if any, be specified on the contest web-page.

If prizes are offered the actual retail value of prizes may vary. Prizes are limited to one (1) prize per winner. The prize cannot be assigned, transferred, redeemed for cash or substituted except by Appalachian Orthodontics of Lynchburg, who may, at their sole discretion, substitute the prize(s) with one of comparable value if the advertised prize is or becomes unavailable for any reason.

All other expenses not specified herein are the responsibility of the Winner. ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER. The prize is awarded without warranty, express or implied, of any kind.

9. Contest Access and Operations:

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any reason, as determined by Appalachian Orthodontics of Lynchburg in its sole discretion, Appalachian Orthodontics of Lynchburg may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Contest Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. Appalachian Orthodontics of Lynchburg reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry or voting process, the spirit of the entry or voting process or the operation of the Contest or be acting in violation of these Official Contest Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Appalachian Orthodontics of Lynchburg reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by Appalachian Orthodontics of Lynchburg to enforce any provision of these Official Contest Rules shall not constitute a waiver of that provision.

10. General Conditions:

Entrant represents that any photo(s), video(s), written material, and other materials submitted as part of Entrant’s Contest entry are original and will not constitute an invasion of privacy or otherwise infringe upon the rights of any third party, and that the Entrant owns or has the rights to convey any and all right and title in such (photo(s), video(s), essay, etc.) and other materials. In addition, by entering, Entrant grants to Appalachian Orthodontics of Lynchburg a non-exclusive, worldwide, royalty-free license to edit, publish, promote, republish at any time in the future and otherwise use Entrant’s submitted photo(s) or videos, written material, and/or other materials submitted, along with Entrant’s name, likeness, biographical information, and any other information provided by Entrant, in any and all media for possible editorial, promotional or advertising purposes, without further permission, notice or compensation (except where prohibited by law). Potential Winner(s), as a condition of receiving any prize, also may be required to sign and return an Affidavit of Eligibility, Liability Release and a Publicity Release within 5 days following the date of first attempted notification, certifying, among other things, the following: (a) entry does not defame or invade the privacy of any party; (b) entry does not infringe upon the rights of any third party; and (c) the photo and/or video and other materials submitted are original and have never been published in a national magazine or website. Failure to comply with this deadline may result in forfeiture of the prize and selection of an alternate winner. Return of any prize and/or prize notification as undeliverable may result in disqualification and selection of an alternate winner. Acceptance of the prize constitutes permission for Appalachian Orthodontics of Lynchburg and its agencies to use Winner’s name and/or likeness, biographical information, (and/or essay, photograph, etc.,) other materials submitted for advertising and promotional purposes without additional compensation, unless prohibited by law.

Participants hereby grant Appalachian Orthodontics of Lynchburg a non-exclusive, perpetual, worldwide license to broadcast, publish, store, reproduce, distribute, syndicate, and otherwise use and exhibit any and all materials submitted as part of the Contest (along with their names, voices, performance and/or likenesses) in all media now known and later come into being for purposes of trade or advertising without further compensation. Participants represent and warrant that they have full legal right, power, and authority to grant Appalachian Orthodontics of Lynchburg the foregoing license and if applicable, have secured all necessary rights from any participants in, and contributors to, their entries in order to grant such a license.

Appalachian Orthodontics of Lynchburg is under no obligation to use any entry in any manner or return the entry to participants.

11. Use of Contest Information:

All entries become the property of Appalachian Orthodontics of Lynchburg. Appalachian Orthodontics of Lynchburg reserves the right to use any and all information related to the contest, including entries provided by the contestants, for editorial, marketing, and any other purpose, unless prohibited by law.

12. Limitations of Liability:

Appalachian Orthodontics of Lynchburg is not responsible for late, lost or misdirected email or for any computer, online, telephone or technical malfunctions that may occur. If for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, Appalachian Orthodontics of Lynchburg may cancel, terminate, modify or suspend the contest.

By participating in the Contest, entrants agree to release and hold harmless Appalachian Orthodontics of Lynchburg, and each of their respective employees, affiliates, agencies, representatives, and agents (Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider, network, server, wireless service provider, or other connections availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application download, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the Contest, and / or the access or use of any of the awarded prizes, the incorrect downloading of the application, the processing of entries application downloads, or in any Contest-related materials; or (f) if injury, death, losses or damages of any kind, to persons, or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

13. Disputes:

Except where prohibited, each Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the contest or any prize awarded shall be resolved individually, without resort to any form of class action and exclusively by the appropriate court located in Virginia. All issues and questions concerning the construction, validity, interpretation and enforceability of these contest web-page rules and Official Contest Rules, entrants rights and obligations, or the rights and obligations of Appalachian Orthodontics of Lynchburg in connection with the contest, shall be governed by, and construed in accordance with, the laws of Virginia, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Virginia.

14. Privacy:

Information collected from entrants is subject to Appalachian Orthodontics of Lynchburg privacy policy.
